What we have learned about the upcoming mediation.
As many of you know, there was never a formal resolution with the County regarding the January 2019 reset of the ground rent going forward.
After numerous attempts by previous boards and the current board, the ground rent issue remains unresolved.
Over the last 1½ years, the current board has engaged with the County, its attorneys, with the Department of Beaches and Harbors, as well as the previous supervisor, Janice Hahn, and the office of our new current supervisor, Holly Mitchell.
In May, 2021 and July, 2021, and in August 2021, COA delivered comprehensive written responses to the County pertaining to this and many other issues.
The County and Essex, beginning in the middle of 2021, were in discussions formulating an arrangement to force a formal Arbitration of the Ground Rent issue. COA recently entered into dialogue with the County and Essex to ensure that we would be an integral part of that process, since the Owners are the ones most affected by the outcome of such an arbitration.
We have insisted that such a process include a mediation as a first step to resolve our differences before proceeding to arbitration. Due primarily to these efforts by COA, the mediation of the Ground Rent issue and related issues is scheduled for August 19. It is a non-binding mediation which includes Essex, the County, and COA. We are hopeful this mediation will be successful so that we can avoid the cost and risk of a formal arbitration with the County. If the mediation is unsuccessful, the formal arbitration with the county will likely take place in November of this year, with a ruling likely by the middle of 2023.

I’ve already commented in the Restaurant Meeting space; however, here is my input about Restaurant operating hours:
I’d like to see Room Service restored on weekends (Sat. & Sun.)….I’ve heard many MCC owners/residents make this same comment.
Also, I’d like the Cafe to be open on Saturdays and Sundays, in addition to weekdays, beginning at 8 a.m.
To me, this would satisfy the MCC Food Amenity requirement at least for the time being. If there is resistance from
Restaurant employees, we need to get new employees.

I don’t think this meeting can avoid the restaurant issues, or the messed up presentation by the Restaurant Board on July 17. I have expressed criticisms of/to the board that they are not making best use of the talent here, that they do too little to let us know all the accomplishments of the board, that they would benefit from getting more input from the owners, that more transparency would be desirable, and some other ideas that could save them time or be of interest. All mostly ignored. I have never been a board member, and I have no real idea of the pressures they or under, HOW THEY MAKE THEIR DIFFICULT DECISIONS, or how I can be most helpful. I do know we elected good people, and that if my “excellent” ideas are being ignored, there is a good chance I just don’t know enough of how issues are dealt with. I’m hoping others exercise the same caution when expressing opinions, and give the board the benefit of the doubt. And if you have really good ideas perhaps you could offer to run for the board or find others to suggest. This is not meant to imply that we can’t offer suggestions, but let’s be positive without second guessing decisions that have been made, WHEN I DON’T HAVE ALL OF THE FACTS.” I’m hoping others will keep all this in mind during our meeting. I find things so complicated, that I don’t always agree with myself!

I believe we need a copy of the Sodexo contract, otherwise we are clueless to comment.
How do they plan to operate and is there a formal business plan? Do they bring in their own staff or do we need to hire people?
What may be the additional shadow costs for this move overall?
Key question- how many people or percentage of individuals use the restaurant and frequency?
We would like to mention the work we have done to have stopped homeless camps from encroaching on us. A group of regular early morning swimmers helped the board and management identify safety and asthetic problems at the West Pool area in advance of its restoration.
